3. User Accounts and Registration

For Job Applicants:

• You must provide accurate information
• You are responsible for maintaining confidentiality of any account credentials
• You must be legally eligible to work where the position is located

For Employers/Recruiters:

• You must have authority to hire for posted positions
• You agree to comply with employment laws and regulations
• You are responsible for job posting accuracy

4. Voice Recording Consent

By participating in voice screening:

• You consent to audio recording and AI analysis
• You understand recordings will be shared with potential employers
• You may withdraw consent (which may affect your application)

5. California Employment Law Compliance

For California Positions:

• Employers must comply with California Fair Employment and Housing Act (FEHA)
• AI assessments cannot be used to discriminate based on protected characteristics
• Salary range disclosure required for California positions (SB 1162)
• Candidates have right to request information about AI decision-making processes

AI in Hiring Transparency:

• We use AI for voice analysis and technical assessment scoring
• AI results are supplemental to human decision-making
• Candidates may request human review of AI-generated assessments

6. Acceptable Use

You agree not to:

• Provide false or misleading information
• Attempt to circumvent our AI assessment tools
• Use the platform for any illegal purposes
• Interfere with platform security or functionality
• Violate any applicable laws or regulations

7. Intellectual Property

• Alloy Hire retains rights to our platform, technology, and AI models
• You retain rights to your submitted content (resume, recordings, etc.)
• You grant us license to use your content for platform operations

8. Assessment Accuracy and Limitations

• AI assessments are tools to assist in hiring decisions
• Results should not be the sole basis for employment decisions
• We do not guarantee accuracy of AI evaluations
• Human judgment should supplement AI recommendations
• California residents may request human review of AI decisions

9. Data Usage and Sharing

• Your data may be shared with potential employers
• We may use aggregated, anonymized data for platform improvement
• Detailed data practices are outlined in our Privacy Policy
• California residents have additional rights under CCPA (see Privacy Policy)

10. Biometric Information (California)

For California Users:

• Voice recordings may constitute biometric identifiers under California law
• We obtain consent before collecting voice data
• Voice data is stored securely and deleted according to retention schedule
• You may request deletion of biometric data

11. Disclaimers

• Platform provided "as is" without warranties
• We do not guarantee job placement or hiring outcomes
• Technical assessments are evaluative tools, not definitive measures

12. Limitation of Liability

Alloy Hire's liability is limited to the maximum extent permitted by law. We are not liable for:

• Employment decisions made by third parties
• Technical issues or platform downtime
• Indirect, consequential, or punitive damages

13. Indemnification

You agree to indemnify Alloy Hire against claims arising from your use of the platform or violation of these terms.

14. Termination

We may terminate or suspend access for violations of these terms or for any reason with notice.

15. Governing Law and Dispute Resolution

• These terms are governed by Delaware law
• California residents: Disputes may be resolved in California courts
